K.S.A. 65-516 Restrictions on persons maintaining or residing, working or volunteering at child care facility; criminal history check by secretary of health and environment; information to be provided sponsoring child placement agency; child care criminal background and fingerprinting fund.
Description : Facility is allowing two known prohibited persons to regularly work in the facility.
K.S.A. 65-512 Inspections.
Description : Staff did not provide reasonable information when providing inaccurate names of staff working the day of the survey.
K.S.A. 65-508 Equipment, supplies, accommodations; competent supervision and care of children; safe sleep practices; rules and regulations; immunizations. (a) (3) be operated with strict regard to the health, safety and welfare of any woman or child.
Description : Facility is not operating with strict regard to the health, comfort, safety and social welfare of the children when a staff member was told to come to work after a doctor provided a note to stay home until 8/18/21.
K.A.R. 28-4-440 Infant and toddler programs. (h) ( 2) (C) If an infant falls asleep on a surface other than a crib or playpen, the infant shall be moved to a crib or playpen.
Description : One infant, 5 weeks old, was not moved to a crib when the infant was sleeping in the bouncer. Infant was moved to a crib at the request of the surveyor.
K.A.R. 28-4-436 Child care centers: physical plant. (b) (3) Each crib or cot shall be equipped with individually-labeled bottom sheet. Every child shall have a cover. Children shall not share bedding.
Description : Children in three units did not have a bottom sheet at naptime.
K.A.R. 28-4-429 Staff qualifications. (h) Each unit shall have one staff person who is at least 18 years of age and who has a high school diploma or its equivalent. Units enrolling fewer than 13 children shall have a staff person who meets the training requirements specified in subsection (b) of this rule and regulation. Units enrolling 13 to 24 children shall have a staff person who meets the training requirements specified in subsection (c) of this rule and regulation. Units enrolling more than 24 school-age children shall have a staff person who meets the requirements specified in subsection (d) of this rule and regulation.
Description : Three units do not have a staff person meeting the training requirements for the maximum capacity as stated on the license.
K.A.R. 28-4-428 Staff requirements. Description : The minimum staff to child ratio was not maintained in two units. The Airplane unit had one staff member with 10 toddlers and the Tree House unit has one staff member with six children between 6 weeks to 3 years of age (five of the children were infants).
K.A.R. 28-4-427 Program. (a) Programs shall be conducted in self-contained units with staff and children designated for each unit. Centers or preschools which cannot develop self-contained units shall present a plan for space use to the Kansas department of health and environment for approval.
Description : Two children were not in designated units when they were dropped off by an employee to go do the bus run. The children were left in the office with a staff member.
K.A.R. 28-4-426 Administration. (a) There shall be a written delegation of administrative authority designating the person in charge in the facility for all hours of operation.
Description : A current written delegations of administrative authority is not available.
K.A.R. 28-4-421 Terms of license. (a) (1) License capacity shall be determined by age of children, available space, program director qualifications, and number of self-contained units per facility.
Description : Terms of the license was not maintained in three units. The Tree house unit is licensed for six children between 2 weeks to 12 months or 2 weeks to 6 years (maximum 4 infants) and was operating with 6 children between 6 weeks and 3 years of age with five infants present. The Airplane unit is licensed for 10 children 12 months to 2 1/2 years and was operating with 10 children 1.6 years to 2.10 years. The Circus unit is licensed for 23 children 3 years to school age was operating with six children between the ages of 3 years to 9 years of age.
K.A.R. 28-4-126 Health of persons 16 years or older in child care facilities. (a) (1) Each person caring for children shall be free from physical, mental or emotional handicaps as necessary to protect the health, safety and welfare of the children, and shall be qualified by temperament, emotional maturity, sound judgment, and an understanding of children.
Description : Staff member did not demonstrate an understanding of children when taping a child's shoes to her feet so she could not remove the shoes.
K.A.R. 28-4-125 Background checks. (a) (3) before allowing any individual to work, regularly volunteer, or reside in the facility and before allowing any individual whose activities involve either supervised or unsupervised access to children to be in the facility;
Description : Facility did not submit identifying information for two individuals as required for background checks.
